    Gidday All,Towards the end of last year I conducted a surveillance on a Gyro Club up this way. CASA chose to do an audit on me conducting a surveillance (Big Brother?), just to make sure that ASRA is behaving in an appropriate manner.Unfortunately, or fortunately as it turns out, I was obliged to note that not one single seat gyro present complied fully with CAO 95.12 in that they all had a fuel capacity in excess of the 36 litre limit specified in the CAO with which you are all familiar!!!To their credit, the CASA auditors entered into discussion with me regarding this situation, and they offered do something to remedy the situation. The main problem is was that times have changed, and the regulations have not kept pace with the changes. The manner in which the regs have to be changed provides another hurdle. The fact that there is no commercially avilable off-the-shelf seat tank that is less than 40 litres is significant. The modification of these readily available tanks to comply with the regs was discussed and found to be impractical, let alone financially viable.So, the long and short is that CASA has issued an amendment to CAO 95.12 which deletes the limitation of a maximum fuel capacity of 36 litres.I will try to attach the Instrument to this post, but if it is not successful, you may email me privately for a copy, or view it on the CASA website.Now you can all go and fly safely as well as more legal.Regards,Waddles.         Allan,You are to be commended for your efforts, thank you. (Post commendation here ... do we have one? oo, don't know, what do they look like? Don't ask me, I haven't seen one. Hmm, we'll have to make one up, keep it simple though, it might go to his head.. ok here goes!) You !@#$%^& Ripper! :>(Will he like it? Don't know - wait and see, maybe he won't notice it amoungst all this verbage.)The CASA officers, David Garnock and Richard Macfarlane, should be commended for their common sense attitude toward what has been a non sensical and problematic issue for some time.             The 36 litre tank only ever referred to Single Seat Gyroplanes, not Two Seaters.LlewellaYou shouldn't push your luck. Play it safe and move the ladder..

              Two questions if i may,1. Is this in effect now or are they just starting to look at it now? Yes i did read the casa site thingy, but it sounded a little double dutch.2. Is the 250kgs EMPTY weight class, with or without the fuel load? the empty part is still a little confussing.Remember -- A good friend will come and bail you out of jail...BUT a true friend will be sitting next to you saying, "Damn...that was fun!"Mark

                Gidday Bones & All,I am advised that as this Instrument has been published on the CASA website, it is in effect immediately.The empty weight of a gyro includes the airframe ready for flight including all the normal fittings and extras (radios, spares, survival equipment etc), and it includes UNUSABLE fuel. There was a time when oil was not included, but these days, it is generally included in the empty weight, and this fact is annotated in the Flight Manual for the gyro (and you all have one of those, right?) Where the engine is an oil injected 2 stroke, again, UNUSABLE oil should be included. To comply with CAO 95.12 (Single seat gyros), the figure that you come up with here must be less than 250 kgs.There still remains what I and others perceive to be a problem with CAO 95.12.1 (2 place gyros), in that this not only puts a restriction on the maximum empty weight, but also the maximum all up weight. We have argued in the past, and will continue to do so to have this relaxed, but at the moment it is not looking good. We are contunually told, wait for CASR Part 103. This may be law by late 2007, so I don't hold my breath any more.Hope this has been of some help. If not ask away, but be quick 'cos I'm off to work in the morning.Regards,Waddles.PS.
